Jeff Shipp – City of Williamstown Open Record Request 12-14-2017

On December 14, 2017 at approximately 2:15pm we received an open record request from the Law Offices of Wallace Boggs, PLLC.  The requester is Jeffery C. Shipp.  Since Mr. Shipp is the City of Williamstown attorney, we are treating this as an open records request on behalf of the City of Williamstown.

The request asks for various documents related to the operation of the City of Dry Ridge Fire Department.  More specifically the EMS services provided by the fire department.  The request asks for documents specific to the Dry Ridge Fire Department/ Ambulance EMS Department.  That is not the licensed name of the EMS service.  The correct name is Dry Ridge Fire Department.  All the following documents and responses pertain to the Dry Ridge Fire Department.

Responses to Request

  1. All budget(s), including line items for the last five (5) years for the fire department and Dry Ridge Ambulance/EMS;
  2. All written documents and written materials that supports the assertion that the Dry Ridge Ambulance Service comprises 87% of the Dry Ridge Fire Department/Ambulance EMS Department;
  3. All filings with any state agency pertaining to the Dry Ridge Certificate of Need issued by the Commonwealth of Kentucky for the last five (5) years;
  4. A copy of the current Dry Ridge Certificate of Need for EMS and/or Ambulance Services issued by the Commonwealth of Kentucky;
  5. Please provide written copies of your rate sheets for services rendered by the Dry Ridge Ambulance/EMS;
  6. Copies of all audits and audit reports pertaining to the Dry Ridge Fire Department for the last five (5) years;
  7. Copies of all Dry Ridge annualized audit reports for the previous five (5) years;
    • All of our audits are annualized so refer to the documents provided in question 6.
  8. Any and all written records, documents and balance sheets for accounts receivables and/or paid by 3 rd party insurance companies including but not limited to health, casualty, no fault, PIP, Medicare and/or Medicaid reimbursement for services rendered by the Dry Ridge Ambulance/EMS for the previous five (5) years (2013-2017);
  9. Any and all written documents and/or written materials regarding insurance payments paid on behalf of Dry Ridge residents for ambulance/EMS;
    • We do not track insurance payments based on residency.  Please refer to the documents provided in question number 13.
  10. Any and all written documents and/or written materials regarding insurance payments paid on behalf of non-Dry Ridge residents for ambulance/EMS;
    • We do not track insurance payments based on residency.  Please refer to the documents provided in question number 13.
  11. All receipts/payments above the permitted/allowed charge by insurance carriers, including Medicare/Medicaid received by or from non-Dry Ridge residents by the City of Dry Ridge for ambulance/EMS services;
    • There were no payments above the permitted/allowed limits.
  12. All third party reimbursement agreements/contracts between 3 rd party insurance companies, including Medicare and Medicaid and the City of Dry Ridge, Kentucky on behalf of or through the Dry Ridge Ambulance/EMS (2013-2017);
    • We do not possess these records in house.  Our third party billing company holds those agreements on our behalf.  We have requested a copy of all of those agreements.  They are advising us that due to the complexity and the amounted of resources required to compile the documents, they will need an undetermined additional amount of time to fulfill the request.
  13. All budget sheets and/or financial reports, line item reports, setting forth all forms, amounts, and source of all monetary payments made to the City of Dry Ridge Ambulance/EMS by the 3rd party insurance provider of any kind and/or individuals from 2013-2017;
  14. Copies of all written policies and procedures and/or manuals utilized by Dry Ridge Fire and Ambulance/EMS from 2013-2017;
  15. Copies of the Dry Ridge Fire Department budget from 2013-2017 without and/or excluding the Dry Ridge EMS/Ambulance included;
    • The Dry Ridge Fire Department Budget includes EMS.  There is no fire department excluding EMS budget.  Please refer to documents provided in question number 1.
  16. Any and all documents and/or materials that document the cost(s) of providing a staffed ambulance per run for Basic Life Support from 2013-2017;
    • There is no document that defines the costs of providing a staffed ambulance for BLS calls.  The cost of providing a staffed ambulances is included in the budget. Please refer to documents provided in question number 1.
  17. Any and all documents and/or materials that document the cost(s) of providing a staffed ambulance run for Advanced Life Support/Paramedic from 2013-2017;
    • There is no document that defines the costs of providing a staffed ambulance for ALS calls.  The cost of providing a staffed ambulances is included in the budget. Please refer to documents provided in question number 1.
  18. Amount of money receivables collected from 2013-2017 under HARD billing versus SOFT billing for the Dry Ridge EMS/Ambulance.
